As more information emerges.. this starts to get good. In this article, it comes to light that Jason West and Vince Zampella have sued Activision. Good on you boys. My bet is still that they were being told how to make their games to rake in the cash from the IP rather than make their games to kick ass.

That didn't cut the mustard with them when they were at EA and I doubt it tastes appealing now. Charges that royalties were coming due and to avoid them, Activision fired them instead, seem well within possibility. Too much speculation is never a good thing, but then again I have never been good at being good, so here goes.

Jason and Vince, through arbitration reach a cash settlement with Activision. The question of rights to MW or COD is mute since Activision knows this is a cash cow on crack. Jason and Vince start a new studio and kick so much ass that they are in a position to name their price again.. but, instead they don't sell and just keep making great games.

Time will tell how they fare but get ready for this...

So, if you're like me and want to play games... and buy games.. you might expect them to work.

Considering the debacle that IWNET was on launch, and EA's promises that it would never do gamers like that, it's really ironic that they have just screwed everyone that pre-ordered and bought the game already.

No kidding.. high traffic?

 After the 30 minute patching process (patching already? Read= Shipped with known major issues)I was able to try the game out. What followed was an exercise in head banging and frustration. I figured that I'd follow the path of least resistance and go with the matchmaking. Set to all maps and all game types, the server browser could not find a place for me to be.. so I was left to do it myself.

Don't get me wrong.. I love the server browser.. But like anything.. if it does not work, then it's as good as not being there. As you can see... it doesnt :(

So, what does a guy do? He finds a game and is persistent until he gets in... 

This lead to PB failures abounding and in the end, not being able to play. What does evenbalance.com have to say about the issues? Well, if you look for BFBC2 support on their site.. the last version they support is the beta.. so of course the release version does not match the beta code!... Gar.. were they not allowed the final exe? Why is it not supported on launch?

What a terrible way to launch a game. I had high hopes with EA bemoaning the way gamers were treated with failing servers and services that did not hold up to the load that occured with Activision/Cod6... but in the end, I have to wonder how much was them telling us that just for the $$. People telling other to "quit crying, they'll fix it" is the wrong attitude for sure. When I buy something, I want it to work.. and if it doesn't, I'll voice that problem in any venue that could get results. Constructively is the best way, but when someone spent $50 and in many cases took a day off to play this game.. they have a right to be displeased and demand answers. I know I do.. but moreso.. I just want to play the game.

UPDATE 12:02 AM: Double Fine's Tim Schafer, who had his own troubles with Activision over the release of Brutal Legend, recently commented on Twitter about what's happening between Infinity Ward and Activision.

"Getting mad at Activision for this kind of thing is like getting mad at an ape for throwing feces," said Schafer. "It's just how the beast communicates."

UPDATE 11:20 PM: It turns out Activision may have showed their hand in this matter earlier today.

In an SEC filing made this morning, Activision cited a human resources investigation into "breaches of contract and insubordination by two senior employees at Infinity Ward."

Based on the information we currently have, at least one of those employees may have included Infinity Ward CTO Jason West. It's possible Vince Zampella is the other unmentioned employee.

"This matter is expected to involve the departure of key personnel and litigation," read the filing. "At present, the Company does not expect this matter to have a material impact on the Company."

UPDATE 11:11 PM: Infinity Ward community manager Robert Bowling has vaguely addressed the situation.

"I should also say, while I appreciate all the calls, tweets, messages and hearing my ringtone a lot," said Bowling on his Twitter account, "they're in vain - as I have no info."

UPDATE 10:07 PM: More developments on the situation at Infinity Ward have come to light.

A screen shot surfaced from Infinity Ward CTO Jason West's Facebook page at Kotaku with the status update "Jason West is drinking. Also, unemployed." I can confirm from a source that's friends with West that update did actually come from West's account.

West also updated his Linkedin profile to appears to reflect a change in employment.
